Our services are governed by the following terms and conditions.

1. SUBSCRIPTION TO OUR SERVICES

Before subscribing to our services, you must carefully read the terms and conditions.
Violation of any of the terms and conditions of the services we provide may result in the suspension or cancellation of the services you subscribed to.
Subscribing to the services implies knowledge and acceptance of our terms and conditions for using our service.
It is advisable to regularly read our terms and conditions to stay informed of updates or changes.
You should not subscribe to our services if you do not agree with our conditions or have doubts that you want clarified in advance.
Our services are not intended for minors. If you are under 18 years of age, you should not subscribe to our services.


2. RESPONSIBILITIES

CRIATIVATEK is not responsible for damages resulting from interferences, interruptions, computer viruses, hacker attacks, or operating system failures or disconnections that may temporarily prevent access, navigation, or service provision to Users.
We cannot guarantee that after a hacker attack, it will be possible to recover the website/online store. CRIATIVATEK cannot be held responsible for losses or damages resulting from hacker attacks.
We are not responsible for the loss of information on your online store, website, emails, web hosting account, or other services provided by us.
We do not guarantee that the service provided is 100% error-free or bug-free.
We do not guarantee that the services we provide work 100% on all browsers and computers.
The customer acknowledges and accepts that it is not possible to guarantee continuous, uninterrupted use of our services, and there may be situations where the platform on which the services are provided is unable to function properly, leading to a service interruption.
The customer who acquires our services is solely responsible for what happens within their web hosting account on the server or on the web platforms provided by us, even if these problems have been caused by third parties. CRIATIVATEK is not responsible for the actions that our customers or third parties take on the server or on the web platforms provided by us.
When you subscribe to our services, you will have access to a password to manage your website, online store, or other services. The password is unique, personal, and non-transferable, and it is your responsibility to use it properly and keep it confidential. We are not responsible for any failure, loss, or theft of the password or any other act that jeopardizes the correct operation of the subscribed services.
By subscribing to our services, you are responsible for any activity and content (videos, photos, texts, links, etc.) that you publish on your website or online store or that you place in your web hosting account.
It is prohibited to insert content on our servers, websites, or online stores or any information whose content is obscene, pornographic, illegal, or that may jeopardize the security, privacy, or intellectual property of anyone, including copyrights, trademarks, patents, etc.
The use of our services is entirely your responsibility. You should not transmit, advertise, distribute, sell, display, or publish any information, software, data, files, or any other material that violates any law or regulation.
We do not guarantee that the quality of our services meets your expectations.
It is the responsibility of the user of our services to ensure that the changes made to their online store, website, web hosting, or other services do not jeopardize the viability, storage, or security of existing data and proper operation.
You should not use our services for any illegal or unauthorized purpose that violates laws and regulations.
Our services are provided using quality servers that comply with all security policies; however, we cannot guarantee the total security of the server, and we cannot be held responsible for any loss, misuse, or by third parties, of any data captured or stored on the server.
CRIATIVATEK cannot be held responsible for losses or damages resulting from the correct operation of the services provided, their suspension, or cancellation.


3. EMAIL SENDING/RECEIVING/MAILING LISTS AND SPAM

CRIATIVATEK servers cannot be the source or intermediaries in the transmission of "SPAM". We consider "SPAM" to be all unsolicited emails targeting newsgroups and Emails. Sending emails to third-party acquired email address listings is considered spam.
If your account is involved in "SPAM" activities, CRIATIVATEK reserves the right to cancel it without any refund. CRIATIVATEK is not responsible for any data loss and damages that may result from it.
There is a limitation of sending 300 emails/hour per SMTP.
Checking emails by POP3 is limited to 30 checks/hour.
CRIATIVATEK cannot be held responsible for losses or damages resulting from the correct operation of the services provided, their suspension, or cancellation.


4. BACKUPS

It is the client's obligation to maintain backups of all their files, databases, or any other content in their web hosting account, website, or online store. CRIATIVATEK has backup systems, but under no circumstances can be held responsible for content loss. The client is responsible for their content and should make backups.
All clients should make security backups before any changes that may compromise the integrity of the contracted services.
In certain situations, CRIATIVATEK may provide the backups it has; this type of support incurs a previously budgeted cost presented to the client.


5. SUPPORT

CRIATIVATEK provides support via email. The response to support requests is not subject to an average response time.
Our offices operate between 10:00 am and 6:00 pm, Monday to Friday, closed on Saturdays, Sundays, and holidays.
Our support is limited to problems with the services acquired by the customer.
The customer is responsible for having all the necessary equipment for the full use of the services acquired, both in terms of hardware and software. The configuration of these equipment and its subsequent use is the customer's responsibility and is not covered by the support provided by us.
Problems related to programming errors, changes in computer systems, email configuration, lack of knowledge of use, or others that require action by the CRIATIVATEK team may be subject to a fee, budgeted by our team and approved in advance by the customer.

6. VALUES, PAYMENTS, AND INVOICING

CRIATIVATEK reserves the right to, at any time, change the price list of the services sold.
Payments must be made up to 5 working days before the indicated date of expiration of the services we provide. If payment is not made within the stipulated period, we reserve the right to suspend or cancel the services, and CRIATIVATEK cannot be held responsible for any resulting losses or damages.
All services provided by us are subject to invoicing. After receiving payment, CRIATIVATEK will provide the corresponding electronic cash sale. In extraordinary situations, we may send an advance invoice at the customer's request.
Payment reminders will be sent 30, 15, and 5 days in advance via email. After the services' expiration date, they will be suspended or canceled. CRIATIVATEK is not responsible for any data loss and damages that may result from it.
For the reactivation of services, there is a reactivation fee. Please note that some services may not be reactivated after they have expired.
CRIATIVATEK reserves the right to suspend and/or cancel all services acquired by our customers if there are outstanding payments for more than 30 days. The customer will be notified by email to make the outstanding payments, and if the payment is not made within a maximum of 5 days, all services associated with that customer will be canceled.
The customer is responsible for keeping all contact/billing data updated, and CRIATIVATEK cannot be held responsible for problems resulting from this situation.
CRIATIVATEK cannot be held responsible for losses or damages resulting from the suspension and cancellation of services.


7. SUSPENSIONS AND CANCELLATIONS

CRIATIVATEK reserves the right to suspend and/or cancel the services acquired by our customers. If the cancellation is due to a violation by the customer of any of the service conditions described in this document, no refund will be made.
Customers can cancel the service at any time; this does not obligate CRIATIVATEK to provide a refund.
Our servers cannot be the source or intermediaries in the transmission of "SPAM." If your account is involved in "SPAM" activities, we reserve the right to suspend or cancel it without any refund. There is a limitation of sending three hundred emails/hour per SMTP.
The customer can cancel the services they subscribed to at any time; there are no contracts.
When canceling the plan related to our services, all your content will be deleted from our servers.
CRIATIVATEK reserves the right to suspend and/or cancel all services acquired by our customers if there are outstanding payments for more than 30 days. The customer will be notified by email to make the outstanding payments, and if the payment is not made within a maximum of 5 days, all services associated with that customer will be canceled.
CRIATIVATEK cannot be held responsible for losses or damages resulting from the suspension and cancellation of services.


8. PRIVACY POLICY

CRIATIVATEK values privacy in the services it provides to its customers.
Your data will never be provided to third parties. The customer is responsible for the accuracy of the data communicated to CRIATIVATEK.
If any public or state entity requests the information of a specific customer, we will not hesitate to transmit it.


9. COOKIES

We only use Analytical Cookies that store statistical information.
Cookies are small text files that a website, when visited by the user, places on their computer or mobile device through the internet browser.
The cookies used do not collect information that identifies the user. Cookies collect generic information, such as how users arrive and use the sites or the region/countries through which they access the site, etc.
Cookies only retain information related to your preferences.

These general conditions of the services provided by us, as well as the entire relationship between CRIATIVATEK and the customer regarding them, will be governed by Portuguese law, expressly submitting the parties to the jurisdiction of the Judges and Courts of Portugal.
CRIATIVATEK is a brand of the company Horizonlevel, Lda with VAT: 513354166 created to promote domain registration services, web hosting, website creation, online stores, digital marketing, and graphic design services.
